Role Of The Privy Council And The Attorney General Of Singapore In The Constitution Of Singapore

 

The Constitution of the Republic of Singapore is one of the oldest constitutional arrangements in the world. The Constitution Act of Singapore established the country on 15 Aug 1965 by an Act of Parliament. It includes sections dealing with the Constitutions and powers of government of Singapore, including the freedom of speech and press, freedom of assembly and association, and the right to strike. Some other sections dealing with some specific subjects are inserted as the Articles of Agreement in the Constitution of Singapore.

One of the organs of state in Singapore is the Privy Council, which is empowered by the constitution to act as the consulted authority or adviser to the government of the day on all matters relating to the constitution and administrative matters. Other bodies like the Public Office Commission and the Law Society of Singapore likewise have their say in the formulation of the constitution. The chief justice of the Supreme Court and the chief executive of the government are sworn-in officers of the government and are responsible to the constitution for the orderly implementation of the constitution.

Particular bodies of the legislature of Singapore were empowered by the constitution to enact laws and impose penalties for infractions of the constitution. These include the Senate, the House of Representatives, the Privy Council, and the High Court. The procedure for incorporating a new law in Singapore is generally through a referendum involving the approval by a majority of voters in an election for a legislative body.

Singapore's constitution was incorporated in the Constitution of the United States as the Bill of Rights; it provides protection to all Americans, including foreigners, and guarantees the rights set forth in the document to every citizen of the United States. However, the context in which the provision concerning the public office and principal executive is intended indicates that the provision is intended to confer upon the Singaporean government the power to bind the people of Singapore by its domestic public law. While this provision does not bind the people of Singapore in any way, it does limit the power of the government in regard to the exercise of powers exercisable by the people of the straits times Singapore under the constitution.

As indicated by the context otherwise required in the second sentence of article 9 of the Constitution of the Republic of Singapore, the power of the Privy Council under the Government of Singapore is conferred upon the Privy Council, and the right to seat the chief justice of England and Wales is conferred upon the chief justice. These two functions are conferred upon the Privy Council by the Constitution of Singapore, article 9 thereof. Article 13 thereof provides that the chief justice may appoint such additional members as may be necessary to the courts of record of Singapore. With regard to the provision concerning the chief justice of England and Wales, the provision for the appointment of additional members of the Privy Council is provided for in the Constitution of Singapore, article 13 thereof.

In the same way, the powers conferred upon the judges of the High Court under the Constitution of Singapore are also conferred upon the high court, the chief justice and the members of the Privy Council who have been already designated as judges of that High Court by the constitution. In a few instances, however, there is a difference between the word "minister" and "prime minister". In the word "minister", the word" ministry" is used while "prime minister" is used in regard to matters relating to the executive branch of government. In instances where the constitution contains a word describing the chief executive as "lieutenant-minister", the word "prime minister" is used instead of "minister". It must be noted that the word "lieutenant-minister" is used here in the Constitution of Singapore, and not in the Constitution of the country, India or any other country for that matter.
